Any Actual Wording Banning Backyard Chickens in Ormond Beach, Florida?

Are there any lawyers, law makers, word wizards, etc;, out there that can look at Section 5 of the Ormond Beach codes and see if there is anything actually not allowing backyard chickens? I've looked and the closest I see is "livestock", but in the code nowhere does it say poultry, fowl, chicken, hen, rooster, etc.

I have prepped my argument just in case I am ever questioned about my birds.

The reason I ask is because I've called the city and can not get a straight answer from anyone there. One person told me that they "really didn't know". The person in code enforcement said "In short, no, chickens are not allowed". I've asked code enforcement where in the codes does it state that birds are not allowed, no straight answer.

If in fact chickens are not allowed, how would I go about possibly changing this?

You give a good argument, you 've given substantial evidence or clarification in your case. However some would look at livestock as what it is, chickens included. Are there others in your area who agree with you. You could start a petition if it comes down to it.The more information pertaining to your claim, the better it will be. Seek out others that have bin in your situation & obtained legal ground to stand on.This is just my opinion you're doing good so far, all the best, keep us posted

Substantiate your claim/ case.,which you've done now find others research.Once you get all your eggs in row ,feel confident not cocky, go forth. Sorry for the word play however it's a reminder of what you're fighting for, so get cracking, your feathered family members are depending on you.

Does Ormond Beach have open Planning Commission or Zoning Commission meetings (or whoever it is in your community that writes the Ordinances!). I ask, because in the Township I live in, they are currently trying to change the ordinances. They are hoping to put much higher restrictions on those of us living in the more rural parts of our community. These restrictions would limit the number of chickens I would be allowed to have. Currently I am not limited... if this goes through I would be limited to 12 (talk about Sophie's Choice, how in the world would I decide who can stay & who goes!!) Well, chicken lovers in our area united. We got the word out (Thank you social media!) & a bunch of us showed up at the Board of Trustees meeting and voiced our concerns. They have tabled the discussion for now & sent the proposed ordinance back to the Planning Commission for review.

You have a right to know what's going on in your community. Show up at a meeting and ask questions. They will probably be happy to see you! Politicians love an audience I know that a member of the Board commented that to his knowledge they had never before had such a high number of people in attendance at a meeting. He loved it!

I'm going to start doing some research, I actually didn't even know who the mayor was until last night, lol. I'm going to call today and really try to get some information. I don't want to make waves in the pool since my neighbors are good and nobody has actually said anything to me, but I'd like for backyard birds to be allowed in my city. Not only what I like them to be allowed, I would like it to not be a mystery within the codes where they are or not. Thanks for the input, I'll start looking at the inner workings in Ormond Beach.

That's a poorly written ordinance. It does not define poultry as livestock meaning they'd be lumped into domesticated animal. My take on that is you can keep poultry but they must be spayed or neutered. Ridiculous. Perhaps you comply if you only keep pullets/hens. Then of course they want your animals registered.

Nowhere in that ordinance are poultry forbidden. As long as you maintain sanitary conditions, confine them to property and don't have noise violations you're good to go. Well, the registering and spayed/neutered issues have to be addressed. And above all remember only the sheriff has authority to remove your birds as you live in a bird sanctuary.

Was thinking the same thing as soon as I got to.... "Animal means every living dumb creature."
By definition it sounds like an "animal" must have written this.

I know this is an old post but I too am wondering what the actual laws are for living in the city of Ormond Beach. I just recently went to Deland and was "certified" to have back yard chickens...that should satisfy the city if their ordinances allow for them. But I really dont see where it says you can or cannot...the wording just seems very evasive. If you have any answers, I sure would appreciate it.
