i have chickens and ducks i set up at flea markets i sell eggs babies and sometimes grown chickens.i make sometimes just enough to buy my feed sometimes i do not even break even.i went to the flea market not to set up just to look around.anyway i was talking to a man that sells poultry.he was telling me in order to sell are poultry at flea markets and stuff like that we are going to have to get a tax permit.so i went to talk to the owner of the flea market and he said yes this is true.that the tax people had been there and telling all the vendors that was selling any kind of bird including people that sell parakeets lovebirds stuff like that.that they are going to have to get a tax permit in order to sell.so now something as i do as a hobby not a living.i am going to have to treat it like a business.are other states doing this or is it just oklahoma

I'm guessing most states operate like that. Unless the folks buying your livestock are engaged in farming then the sales would be taxable just like it was a sale at the pet store.

It's not a big deal to get the sales tax permit. Generally, you fill out a form and send it to the state. They establish the account and from then on you will likely be required to fill out a form and submit the taxes due quarterly. The form has to be remitted even if there is nothing due. They will expect you to report quartely until you tell them that you no longer have a need to.

You will need to keep a ledger of sales and the sales tax collected on each sale.

The only way around it is to have the customer sign an exemption certification. This is from the Oklahoma statutes:

(g) Sales of animals or items exempted by this section will qualify for exemption only where the
purchaser certifies in writing on a copy of each invoice or sales ticket that "(The Purchaser) is
regularly engaged in the business of raising animal life for marketing and that the items
purchased exempt from sales tax will be used only in that business."
 
i got my tax permit today it just makes me mad i am not a big operation just more of a hobby.but like everyone is talking now they are guessing everyone will have to get a tax permit just to set up at flea markets no matter what they have for sale
