Here in UT I believe it could possibly fall under animal cruelty laws, I'm guessing it would depend on the prosecuting attorney and how they saw the facts, but a dog with paintball marks all over it and no injured livestock would look good.

I can guarantee that it isn't a rural legend everywhere. In my area you will be prosecuted under the cruelty to animal laws for bruising a dog with a paintball, breaking the skin with a BB or shooting with a 22 to wound. Shoot to kill or don't shoot at all.

Basically you might have a chance to get around it, but if the prosecuting attorney wanted to, they could get you for animal cruelty charges.
 
The wording of state laws varies but the last time this was debated, the state in question allowed one to humanely kill or injure a dog attacking livestock. Note that it only has to be humane if you kill it since it's difficult to humanely injure an animal.

Dogs Attacking People or Livestock

Generally, it's perfectly legal to do anything necessary to stop a dog caught in the act of attacking a person or livestock. A dog's owner is not legally entitled to any money from someone who injures or kills the dog while protecting a person or farm animal from attack. Nor is the person guilty of a criminal offense; many animal cruelty laws specifically exempt the act of injuring or killing a dog in these circumstances.

Here is the Utah law:

§ 18-1-3. Dogs attacking domestic animals, assistance animals, hoofed protected wildlife, or domestic fowls

Any person may injure or kill a dog while:

(1) the dog is attacking, chasing, or worrying:
(a) a domestic animal having a commercial value;
(b) a service animal, as defined in Section 62A-5b-102; or
(c) any species of hoofed protected wildlife;

(2) the dog is attacking domestic fowls; or

(3) the dog is being pursued for committing an act described in Subsection (1) or (2).​

Uh, hello, ALL animal owners have rights. A good Samaritan wouldn't allow a dog to run free, injuring any living thing.

What if the dog was attacking a human? A child? Should we just stand back and say "Oh, but dog owners have rights, let's see if Fido's owner can bring little Jimmy back to life or replace his face. Yeah, that's what we'll do. Now, let's all go inside and have a sandwich."

Don't get me wrong. I am a dog person. I love my dogs. But, if they are attacking something and off my property, shoot them before they do more damage.

Idiot.

I'd be surprised if she gets it through with enough signatures. I hope pictures of the dead chickens get as much press as idiot girl.
