Are all Mallards toe clipped or banded at the hatcheries?

Who said it would be a long lengthy legal battle, and yes I will fight when I'm wrongly accused... Generally from my experience a letter and phone calls to the LEO superiors is all it takes to get frivolous accusations tossed, God knows I had plenty of them lodged against me when I had an overly zealous, code enforcement officer in my neighborhood that wrote me dozens of tickets, never paid a fine nor went to court for any of them... Each time he wrote me a frivolous ticket I wrote a note to the chief of police with copies of the laws in question attached and highlighted for clarification... Called to follow up a few days later and a few times even went in to have a face to face if he didn't drop the ticket over the phone... No superior wants egg in their face in front of a judge when you show that you tried to resolve the frivolous ticket outside of court and the superiors couldn't read the law in front of them... My neighborhood finally changed their tune, when someone sued the village and won big time for police and village harassment, they cut a deal did not have to pay the civil reward if they in turn stopped issuing frivolous tickets to the community as a whole and sent the code enforcement officer to get further education...

Fact is it's not a big problem, as you have found out many hatcheries do not mark domestic ducks, if it was a big problem and such a clear violation of laws don't you think they would have been fined out of business long ago? And don't you think there would be numerous post here and in Google searches of people being busted for untagged domestic ducks?

What bothers me the most is since they are all domesticus, why do the regs keep pointing to exceptions for the peking?

Do me a favor, look up the scientific name of the 'peking duck' and than compare it to the scientific name for rouens and khaki campbell...

If you want to mark your ducks have at it, may I suggest you simply contact a local tattoo artist and arrange a time outside the shop for them to scribble a few letters or numbers on the webbing, easier than bands or cutting things off, IMO... You can even go to Ebay and order a few 'livestock' tattoo numbers/letters and some ink, no need for the press, just put some ink on a paper plate, dip the letter/number dies into the ink puddle and press into the ducks webbing... Although it would still likely suggest finding a local tattoo artist willing to do it for you for the shop minimum, based on my experience managing a shop and my brother owning it, it probably won't be hard to find an artist willing to tattoo the duck webbing outside the shops back door or at their house or yours...

End of Quote. Although, not being aggressively enforced at this time, if your are lulled into complacency, you could be caught with your pants down and subject to the hand of the "LAW". When you obtain your permits you will be required to conform to the cage rule for wildlife and you will waive your 4th amendment right to protection from unreasonable search and seizure as the LEO's will have the "power" to "inspect" at ANY time. Lord knows, I wish I was mistaken, it's like being a doctor and having to tell your best friend they have a terminal illness. Also, 1 complaint about the "noisy, smelly," ducks will bring down fire from the heavens. Please don't ditz me for the info, it's not about who's correct' it's about who's "compliant". LOL, beachlegger.

As I said previous "from what I have read of FL law(s)" I had not seen this rule and it was not discussed previously, but now that it has been brought up...

I have read it and this rule and first and foremost it is not applicable to the Federal marking laws, it's a Florida only rule that clarifies FL law in regards to necessary permits and cages for these ducks...

I still fail to see where it requires or even mentions banding or marking of the ducks under FL law, maybe you can point that part out, the full text is bellow...

68A-4.0052 Possession and Release of Live Mallards.
(1) No person shall possess, import, sell or otherwise transfer, or release live mallards (Anas platyrhynchos), except as provided in this section and other applicable rules of the Commission. For the purposes of this section, “mallard” includes all Anas platyrhynchos and fertile hybrids thereof except the white variety of Anas platyrhynchos commonly known as “Pekin” ducks.
(2) Live mallards may only be sold or transferred to, imported by, or possessed by:
(a) Persons licensed pursuant to Section 379.3712, F.S., and permitted to release mallards pursuant to Rule 68A-12.010, F.A.C.;
(b) Persons permitted to possess mallards pursuant to Rule 68A-6.002, 68A-9.002, or 68A-9.006, F.A.C.; or
(c) Persons licensed pursuant to Section 379.2525 or 379.3761, F.S.
(3) Live mallards may only be sold by persons licensed pursuant to Section 379.2525 or 379.3761, F.S.
(4) Mallards shall be caged as specified in Rules 68A-6.0023 and 68A-6.004, F.A.C. In addition, persons other than those permitted pursuant to Rule 68A-12.010, F.A.C., shall meet the following requirements:
(a) All cages and enclosures containing mallards capable of flight shall be covered at the top to prevent escape, and
(b) East of Jefferson County, cages and enclosures containing flightless mallards shall be covered at the top to prevent interaction with wild waterfowl.
(5) Mallards may only be released pursuant to Rule 68A-12.010, F.A.C., or for bona fide dog training, raptor training for falconry purposes, or field trials provided that persons releasing mallards for dog training, raptor training, or field trials shall return the birds to possession or caging as soon as possible after release.

And please note that the law clearly states "For the purposes of this section, “mallard” includes" thus that definition does not extend outside that section, nor is it applicable to Federal Law(s) 50 CFR 21.13 and 50 CFR 21.14...
 
Dear MeepBeep; Go back to Mallard Possession Rule- 68A-4.0052. Go back to the FAQ. Read question 6 and the answer and you will see that nasty 50 CFR 21.13 and the banding requirements.Metzer Farms didn't know of the Fl codes, rules, etc and ship a zillion ducklings a year, I will forward this info to them at their request They said they will be happy to toe clip ducklings for customers, LOL, beachlegger
 
Dear Daisy; I don't know Nevada's laws, still trying to figure out Fl's. , but Metzer told me they will toe clip on request. Not a bad idea, cheaper and more humane than pinioning a wing or a tattoo. Size charts for rouens show #14, 3/4 inch Seamless metal. Too big for duckling, have to time it right to slip on, prior to 6 weeks of age. Have to make my own from alum. tube cut into 1/4 inch rings and deburred. Lol, beachlegger
