Is my 3 month old a daisy or duke?

The first bird is 12 weeks old. The age at which saddles just start coming in. Going off of coloring alone, that's a cockerel.

Will be interesting to get an update in a few weeks.

I agree the first is likely a cockerel. The colouring is suspicious and blocked over his shoulders and his comb is a bit more prominent than I would expect from a pullet. As for saddles, I don’t think there’s any fast and set rule on them for these guys. Some are more obvious sooner than others but ...
My EE cockerel didn’t get his saddles in until 15 weeks, and his comb stayed pink until close to the same time. It was on the larger side but no more red than my legbar pullet’s (which was also giant of course lol).
The second bird is definitely a pullet.

I have a boy and a girl here, They are maybe a month or so older than yours in this pic. The girl, black, I had wondered for quite a while if she was a boy, and she has the pea comb look your EE has. But she is very girl now. (the rooster I have here is an OE, he is being casual.)
 
She's not (Buff Orpington 29 weeks) technically in the nesting box. She's beside it and she's been in her own little nest she's created for herself from a hole she had dug.
A newly laying hen can't go broody, can they? After one egg? she doesn't trill, or fluff up her feathers when i stuck my hand under her.
Is this just new layer anxiousness and confusion?
