Greetings! While researching keeping chickens in Tempe, I found the Tempe City Code section regarding keeping poultry:

Sec. 6-3. Poultry.

(a) For the purposes of this section, the term "poultry" shall mean chickens, ducks, geese, turkeys, guinea fowl or other domestic fowl.

(b) It shall be unlawful to keep poultry in a manner that constitutes a nuisance.

(c) Poultry shall not be kept within a distance of forty (40) feet from the residence or sleeping quarters of any person other than the owner of such poultry.

(d) Poultry shall not be cooped or confined in any building within seventy-five (75) feet from the residence or sleeping quarters of any person other than the owner of such poultry.
(Code 1967, §§ 6-4—6-6)


Long story short: I won't be keeping chickens myself. Does anyone know of an egg co-op in Tempe or greater Phoenix (ala http://www.bountifulbaskets.org/)?

well that makes NO sense.. it says 40 in one line and 75 in the other and they both say basically the same thing!!!!

I live in a HOA and I dont care about the no chicken rule. I just keep my girls inside the barn (really its a shed) they dont make noise

I understand the hoa has the rules to keep my property value up... but not every one who rasies animals is a hillbilly.. I have a NICE house and I take REALLY good care of all my stuff yet I live next to ppl who have NO grass not paved driveway (all things the hoa says has to be done with in a year of building/p[urchase) so until the hoa enforces all the rules I will have my girls. (and bunnies) they are not obvious and I dont care!!! cause liek I said I will drive down the street and photograph al the freaks that dont obey the rules.... like driving 4 wheelers and snowmachines on the street not allowed but they do it any way. jerks turn thier snowmachines around in my grass and tear it up..... yet I cant have chicekns!!! stoopid hoa I tell ya.... oh they gave a ticket to one of my neighbors for repainting the trim on the house (THE SAME COLOR IS WAS) with out putting in a request..... next house I buy will be on acreage!!! in the mniddle of NOWHERE!!! I love my house but hate where I live!​
 
Hi, I am Nancy and just joined. We live in Phoenix and just encountered a problem regarding our pet chickens. We started with 4 chicks a year ago and one turned out to be a little rooster. He is part of the family but didn't want to disturb the neighbors so at night he came in the house and didn't go out till 8:45 or later during the day. Figured any crowing wouldn't disturb anyone per se, and then last June had another 4 baby chicks and one turned out to be a little rooster also. When he bagan to crow he also came into the house for the night. Anyway, someone finally complained and reported us to the City of Phoenix. Before they came out we were very fortunate and found a wonderful home for both, but when the City did come out, they saw our hens and because of regulations, we are in violation. It reads as follows, "It is unlawful to keep poultry within the City on a parcel of land less than ten thousand square feet without written permission from all lawful occupants and owners of adjoining lots or parcels of land." The City has been helpful and dropped off the documents that we need to comply with and also gave us an extension to accomplish. The hangup is that the signatures need to be notarized, but we have offered to pay for the cost. This might be what is required for you to continue to keep you chickens also. We feel pretty lucky and believe all the neighbors will sign (one neighbor we dont know and has very noisy dogs, and one other neighbor has a cat that has gotten a couple of our chicks and feels bad) and that this will all be just a formality. So check it out. Our chickens are family and we miss our roosters, but still get to see them (visitation privileges...). Good luck.

Tempe allows up to 5 hens in all residential neighborhoods. If you are in agricultural zoning there is no limit, and roos are allowed. There are limits on placing coops in relation to neighbors' homes--specifically their sleeping quarters.

Now HOA CC&Rs are a completely different set of matters. They are a legally binding contract that you agreed to when you purchased your property. Many of the newer and/or larger HOAs have super nit-picky covenants, but there are several of the older ones that do not. Some of the cities in the valley require that all new residential development have an HOA, but Tempe does not; never has.

The 40' referred to in the zoning ordinance is in reference to having them in an outside run/yard. The 75' is in relation to having them caged/cooped. If you house them in a small cage right next to your house I doubt anyone would complain, even if a few feet shy. Likewise, if you let them run around your fenced backyard rather than building them a specific pen you probably won't have problems. The city only investigates code violations when there is a complaint.

Tempe's Zoning Ordinance was completely replaced in early 2003; before that chickens were allowed only in agricultural zoning.

Yeah HOA's are the pits. Seems like the city should be able to control people that park 10 cars in their driveway and leave trash everywhere.. The occasional Barbie pink house gives the neighborhood character. We lived in an HOA community for about 5 years. When we bought the house new there were 3 color choices, with 5 different trim colors All very boring. We love it where we are now. They had an HOA years ago but it just kind of dissolved. Besides it's nice to live on some property and not have to listen to your neighbors.
 
I love my HOA. We don't control paint or planting choices. We do have some say on fences.

We have a true, old-fashioned neighborhood where just about everyone knows everyone; where news of what your kids have been up to usually makes it home before the kids; where kids play in the park and neighbors look out for each other. We have ammenities that wouldn't be possible without the HOA.
